Jackson, TN Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

Jackson Municipal Code § 16-501 makes it unlawful to open, disturb the surface or sub-surface of, or bore under any city street, sidewalk, alley or public way without a permit from the city engineer, except in a declared emergency. An applicant files a written application on city forms and pays a permit fee set by size: twenty-five dollars for an opening of five square feet or less, and two dollars per additional square foot beyond that, with subsurface boring billed at two dollars per square foot of diameter times length.

Separate permits are required for multiple openings or for one continuous opening longer than a city block, and starting work before getting the permit can double both the permit and restoration costs outside an emergency. The city engineer can limit how long a cut may stay open and cancel an expired permit, which then carries a ten-dollar cancellation charge on top of any accrued restoration cost before a new permit issues. Section 16-502 layers on the restoration duty: beyond the permit fee, the permittee pays the City of Jackson to restore the street, must temporarily backfill and tamp the excavation to ninety-five percent Standard Proctor density, and must make complete restoration of cuts in gravel and concrete sidewalks, repairing concrete sidewalks with matching material and the same finished appearance as the original.
