Kyle's encroachment permitting rules sit in Chapter 38, Article II, Division 2, adopted to let people obtain authorization to place a structure in the public right-of-way or a city easement. Section 38-41 states the division's purpose: an efficient process for authorized encroachments that does not interfere with the city's or other utilities' use of the easement, for a limited duration where possible. Section 38-42 defines the key terms: an easement covers utility, drainage, or other city-controlled easements; an encroachment is any structure proposed within a right-of-way or easement; and right-of-way covers the surface and airspace of public thoroughfares and grounds.

Section 38-43 requires a permit application and a signed license agreement (for right-of-way encroachments) or encroachment agreement (for easement encroachments) before locating any structure, and applies only to encroachments not already covered by Chapter 38, Article IV's separate excavation permitting. Section 38-44 lists the required application contents and sets a six-month fee schedule: $250 for a first requested parking-space encroachment, $300 for the second, $350 for the third, and $50 more for each additional space; other encroachment areas of about 166 square feet cost $250, plus $50 for each additional area.
