Long Branch, NJ Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

Chapter 297, Article II covers any work touching a sidewalk, driveway apron, curb or gutter within a public right-of-way. Section 297-5 makes a permit mandatory before construction or removal, and Section 297-6 requires the application to state the applicant's name and address, the name and address of whoever will do the work, the property owner if different, the job location, the estimated cost, and a line-and-grade plan showing the work's exact position relative to a street intersection or other fixed point, its width, its relationship to street and property grade, and, for a driveway apron, its slope.

The Director of Public Works can demand any further information needed to judge code compliance. The permit fee is $5, plus the cost of any tests the Director requires, both payable when the application is filed. All materials and workmanship must follow the city's on-file specifications; removed sidewalks, aprons, curbs or gutters must be promptly replaced to those specifications, concrete sidewalks may never be covered with blacktop, and a required curb cut or driveway depression means the whole affected section of curb must be removed and replaced rather than broken and recapped.

The applicant must notify the Department of Public Works at least 24 hours before pouring or laying any sidewalk, driveway apron, curb or gutter so an inspector can be scheduled. The article exempts sidewalk work covered by a major subdivision's performance guaranties and the repair or replacement of less than eight linear feet of existing sidewalk.
