Parsippany-Troy Hills, NJ Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

Article III of Chapter 360 governs private use of the public street. Section 360-17 makes it unlawful to construct or place construction equipment, construction materials, construction vehicles, construction dumpsters or any other material used for storage or any other purpose in connection with construction in or upon any Township-owned or unaccepted dedicated street, avenue, highway, lane, alley or public place without first obtaining a permit. The permit is valid for 30 days and can be extended for an additional thirty-day period on approval of the Director.

Under § 360-18 the Director of Public Works issues it after the Township Engineer and the Township Police Department approve the application, and the application comes with a $50 fee that the Township Council can amend by resolution. It must show the applicant name and address, the proposed form of construction, the exact location, that the work will not interfere with drainage of the street or impair public health, safety and welfare, and verification that Chapter 360, Article VI has been complied with. Enforcement runs through the nuisance process.

Section 360-19 lets the Township Council, by majority vote, declare any encroachment, obstruction or encumbrance that interferes with drainage or impairs public health, safety or welfare a nuisance and order its removal. Under § 360-20 the Township Clerk notifies the responsible person by registered mail or personal service, and under § 360-21 the Township can abate the nuisance itself if the person fails to act within 30 days after the notice, with the cost becoming a lien on the abutting land. Work on the sidewalk itself is Article IV: § 360-22 requires a Director of Public Works permit to construct or remove any sidewalk, driveway apron, curb or gutter in a public right-of-way, with a fee under § 360-24 of $50 for up to 100 square feet of opening plus $1 per square foot in excess of 100. Under § 360-25, no concrete sidewalk can be replaced or covered with blacktop.
