Rothschild, WI Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

Chapter 184, adopted in 2019 under the Village's authority over streets, highways and utility facilities in Wis. 58, governs any 'facilities' - poles, wires, pipes, cables, conduits, ducts, manholes, vaults and similar equipment - placed within a Village right-of-way, a term the chapter defines to include the surface and space above and below streets, highways, terraces, shoulders, side slopes and public sidewalks. Before placing facilities, an owner must obtain a Village permit, apply on Village forms, and pay the fee set in the Village's fee schedule; the permit can cover installation, maintenance, site cleanup and right-of-way restoration, and an owner accepting it agrees to indemnify the Village against claims arising from the facilities.

The Village may limit or prohibit new facilities based on public need, right-of-way condition, timing and existing infrastructure, and can assign specific corridors that later-installed facilities must relocate into at the next reconstruction or excavation. Owners connecting to a Village bridge must submit an engineer's structural analysis and give up any claim to compensation if the bridge is later repaired or replaced. All right-of-way users must comply with Digger's Hotline location requirements under Wis. 0175, and an owner who fails to locate facilities within 10 days of a Village request, repeatedly within a 12- or 24-month window, risks losing the privilege to keep facilities in the right-of-way or being required to post security.
