Satellite Beach, FL Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

Satellite Beach City Code § 54-32(a) locks down who can touch the surface of a public right-of-way. Outside of the city itself, only a person operating under the express written authority of the city council or city manager may alter, destroy, damage, modify or change the surface, or any part or component, of a street, sidewalk, driveway, curb, drainage inlet or other right-of-way facility or infrastructure. That written authorization functions as the city's encroachment permit for private work touching public sidewalk and street surfaces: without it, altering a sidewalk slab, cutting a curb, or modifying a drainage inlet is a code violation regardless of whether the work happens on private property adjoining the right-of-way.

Subsection (b) carves out one specific, narrow exception adopted by Ordinance No. 990 in 2008: a property owner may paint or stain a concrete driveway on their own property, plus the portion of that driveway crossing the right-of-way from the property line to the edge of the street pavement, and for this purpose the definition of driveway pulls in the sidewalk section located entirely within the driveway's footprint and the driveway apron itself. Subsection (c) puts one further condition on that exception: any paint or stain used has to be a non-slip product, and the building official has to approve it before it's applied. , which is how the city pursues violations of the right-of-way alteration rule.
