Obstructions are continuing nuisances, and the City can remove them at the responsible party's cost after written notice.
(a)Commercial and Industrial Areas. No person having charge or control of any lot or premises, either as owner, lessee, tenant, builder, contractor, house mover or otherwise, shall construct, deposit, keep or maintain any structure, building or any obstacle of any nature whatsoever in or upon any commercial or industrial area, street, parkway or sidewalk abutting on or adjacent to such lot or premises or which will interfere with the free passage of pedestrians or vehicles along such street, parkway or sidewalk. ... (c)Removal of Obstructions. Any obstructions as described in this section that may be constructed, deposited, kept or maintained or that may exist shall not accord any property rights vested or otherwise to the persons described in this Section. Such obstructions are determined to be continuing nuisances, and, subject to written notice by the City, they may be removed at the cost of the responsible party or adjacent property owner as described herein.
Full Breakdown
Section 7230 of the Arcadia Municipal Code covers structural obstructions in the public way. Subsection (a) applies to commercial and industrial areas: no person having charge or control of a lot or premises, whether as owner, lessee, tenant, builder, contractor, house mover or otherwise, shall construct, deposit, keep or maintain any structure, building or obstacle of any nature whatsoever in or upon the street, parkway or sidewalk abutting or adjacent to the lot, or anything that interferes with the free passage of pedestrians or vehicles.
Subsection (b) repeats the same language for residential areas, though it is phrased with the word should instead of shall. Subsection (c) removes any argument about vested rights. An obstruction covered by the section does not give the person who placed or kept it any property right, vested or otherwise. The section declares such obstructions to be continuing nuisances and, subject to written notice by the City, allows removal at the cost of the responsible party or the adjacent property owner.
Other sections in the same chapter close related gaps. Section 7231 bars anyone in charge of a lot, building or premises from sweeping dirt, rubbish or refuse from a sidewalk into the street. Section 7220 requires vegetation to be trimmed so it does not obstruct free passage, with 8 feet of clearance for trees or bushes taller than 15 feet under Section 7220.1. Section 7232 restricts washing building exteriors, except windows, between 6:00 a.m. and 6:00 p.m. along named streets including Huntington Drive, Baldwin Avenue and Santa Anita Avenue.
Work that physically occupies the right-of-way needs a permit. Section 7300.1 makes it unlawful to encroach on any right-of-way without a permit from the Development Services Director, and the definition of encroachment in Section 7300 includes placing or leaving rubbish, brush, earth or other material on a right-of-way and erecting a sign, pole, fence or wall there. Sidewalk cafe tables are handled under the separate sidewalk dining permit in Part 7 of the same chapter.
Violations & Fines
Section 1200 makes any violation of the Code a misdemeanor or an infraction at the city attorney's discretion. A misdemeanor carries a fine of not more than $1,000, imprisonment not exceeding six months, or both. An infraction carries a fine not exceeding $100 for a first violation, $200 for a second within one year, and $500 for a third or later violation within one year. Each day is a separate offense. Under Section 7230(c) the City can also remove the obstruction after written notice and bill the responsible party or adjacent owner.
