El Monte, CA Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

El Monte Municipal Code Section 12.12.010, within Chapter 12.12 (Street and Sidewalk Obstructions), makes it unlawful to place a vehicle, sign, boxes, goods, building materials or any other article on any city street unless a specific code provision or permit allows it. The companion subsection extends the same rule to sidewalks and alleys: no person may cause or permit a building, structure, sign, boxes, goods, building materials, refuse, or any portion of a tree, bush or plant to be or remain in, on or above a public street or alley right-of-way. The only built-in carve-out is for shade or ornamental trees planted in a parkway under authorization from the Director of Public Works.

Because the ban is written as "except as expressly permitted," anyone who needs to place something in the right-of-way, a dumpster, scaffolding, a sidewalk sign, or a bench, must first secure an encroachment permit under Chapter 12.28 (or, for trash bins specifically, Section 8.20.267). Encroachments left in the right-of-way without that permit are removable, and the responsible party is exposed to citation.

Enforcement runs through the city's administrative citation system in Chapter 1.18. A first infraction carries a fine of up to $100, a second offense of the same provision within twelve months rises to $200, and a third or later offense within that same twelve-month window carries up to $500, per Section 1.18.040(B). Fines are due within thirty days of the citation, and a cited party who wants to contest it must request an administrative hearing within twenty-one days under Section 1.18.060, or the citation becomes final.
