Bartow County, GA Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

The Bartow County Right-of-Way Ordinance, Code §55-24, makes it unlawful for any person to obstruct, encroach upon, or materially injure any part of a county right-of-way or road pavement (§55-24(a)). 00 in damage counting labor and materials. 'Obstruct' covers buildup of rock, gravel, mud, dirt or chemicals from vehicle ingress or egress, water diverted onto the right-of-way, and negligently or intentionally dropping hazards such as ladders, trash, debris or branches onto the road. No encroachment, meaning any building, structure, vehicle or object including mailboxes, signs, cars, gates, walls, sprinkler systems, trees or posts located in the right-of-way, is allowed without the community development director's permission unless the article specifically permits it (§55-24(b)).

Buildings, structures, service areas and required off-street parking or loading facilities cannot encroach on county rights-of-way at all, except driveways (§55-24(c)). If the county removes an illegal encroachment or obstruction, it owes the owner no compensation (§55-24(d)). Enforcement runs through the community development director, the county sheriff and code enforcement officers, who can issue citations, seek civil relief or issue stop-work orders (§55-27(b)).
