Summary

Placing anything in a Beloit street, sidewalk or terrace that blocks or encumbers it is prohibited under Beloit Code of Ordinances § 11.05, with narrow carve-outs for small signs, awnings, brief loading and permitted utility work. Owners and occupants can be cited even when someone else placed the obstruction, if they let it remain.

The prohibition of subsection (1) shall not apply to the following:(a)Signs or clocks attached to buildings which project not more than 6' from the face of such building and which do not extend below any point 10' above the sidewalk.(b)Awnings, canopies, marquees, pedestrian bridges permitted under §30.04(15) and §30.12.( ... c)Public Utility encroachments authorized by the City Manager.(d)Goods, wares, merchandise or fixtures being loaded or unloaded which do not extend more than 3' on a sidewalk or terrace, provided such items do not remain thereon for more than 3 hours.(e)Building encroachments permitted under §11.06.

Full Breakdown

Section 11.05(1) bars anyone from encroaching upon or obstructing any street, alley, sidewalk, terrace or other land dedicated to public use, and it extends liability to an owner or occupant who merely permits an encroachment placed by someone else to remain on the public way next to their property. The general ban catches everything from parked equipment to merchandise displays unless the item fits one of the five listed exceptions in § 11.05(2).

Those exceptions are narrow. Signs or clocks attached to a building may project up to 6 feet from the wall, but only if they clear at least 10 feet above the sidewalk. Awnings, canopies, marquees and pedestrian bridges are allowed if they comply with §§ 30.04(15) and 30.12. Public utility encroachments need authorization from the City Manager. Goods, wares or fixtures being loaded or unloaded may extend up to 3 feet onto a sidewalk or terrace, but only for up to 3 hours before they become a violation again. Building encroachments tied to construction, such as sidewalk sheds, are handled separately under § 11.06 rather than this section.

Violations & Fines

An obstruction that does not fit one of the five § 11.05(2) exceptions is a straight violation of § 11.05(1), whether the owner placed it or simply let it stay. The City Engineer and Public Works Director can order an unauthorized encroachment removed, and a person who repeatedly leaves goods or equipment on the sidewalk beyond the 3-hour loading window loses the loading exception entirely and faces the same citation as any other unpermitted obstruction.

Frequently Asked Questions

Can I put a sandwich board sign on the sidewalk in front of my Beloit store?
Only within narrow limits. Section 11.05(2)(a) allows signs attached to the building to project up to 6 feet, provided they stay at least 10 feet above the sidewalk. A freestanding sandwich board sitting directly on the sidewalk is not one of the listed exceptions and counts as a prohibited obstruction under § 11.05(1).
How long can a delivery truck block the sidewalk while unloading in Beloit?
Section 11.05(2)(d) allows goods, wares or fixtures being loaded or unloaded to extend up to 3 feet onto a sidewalk or terrace, but only for up to 3 hours. Past that window, or beyond that 3-foot reach, the load becomes an obstruction under § 11.05(1) even during an active delivery.
Who is responsible if a contractor leaves equipment blocking the sidewalk?
Section 11.05(1) reaches both the person who placed the obstruction and any owner or occupant who permits it to remain on the public way next to their property. That means a property owner can be cited for a contractor's equipment left blocking the sidewalk, not just the contractor.
