Colonie, NY Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

Chapter 63, adopted 2-25-2016 by Local Law No. 1-2016, regulates where a clothing bin, donation bin or recycling bin may sit once a permit is issued. Section 63-7 lays out six placement standards: a bin cannot impede vehicular or pedestrian traffic flow; it cannot sit in the municipal right-of-way and must meet the site's setback standards; it cannot occupy a required parking space or push the site below its minimum parking count under the Land Use Law; it cannot be placed on a sidewalk and must leave at least five feet of pedestrian walkway clear in front of it; it cannot sit within an intersection's sight triangle; and no more than three bins are allowed on any one parcel.

Placement is only half the chapter: § 63-3 requires a Town permit before any bin is erected, valid for one year, applied for through the Planning and Economic Development Department under § 63-4, and § 63-6 obligates the permittee to keep the bin painted, legible and free of graffiti (removed within 72 hours of notice) and to repair, replace or remove a damaged or vandalized bin within five days of notice. A bin's information label under § 63-8 must also disclose whether the operator is a nonprofit or for-profit entity.

Enforcement runs through Code Enforcement Officers, Planning and Economic Development staff, and Colonie Police, who can issue notices of violation, summonses or appearance tickets returnable in Town Court.
