Under Henderson Municipal Code Title 10 and related public right-of-way ordinances, pedestrians must have a continuous, unobstructed path on public sidewalks. Federal ADA rules require a minimum 36-inch clear width, and Henderson enforces at least 4 feet (48 inches) of clear width where feasible. Prohibited obstructions include merchandise displays, A-frame signs without permits, dumpsters, construction debris, parked vehicles, overgrown landscaping, and personal property storage. Restaurants along the Water Street District may place sidewalk tables only under an approved Outdoor Dining permit. Sidewalk encroachment permits are required for construction staging, moving pods, and temporary obstructions exceeding 72 hours. Violators face citations under the code enforcement program, with initial warnings followed by fines escalating for repeat offenses. Blocking ADA access for mobility-impaired individuals may also trigger federal civil rights enforcement. Vegetation overhanging sidewalks must be trimmed to at least 8 feet vertical clearance.
