Kenai Peninsula Borough, AK Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

In the Kenai Peninsula Borough outside the cities, KPB Chapter 14.40 governs use of dedicated rights-of-way, which serve as the borough's rural equivalent of city sidewalks. KPB 14.40.035(C) makes it unlawful for any private person, individual, or entity to regulate or purport to regulate the flow of traffic, or to place a traffic regulatory device or sign within a right-of-way, without the express permission of the borough. The same subsection bars any private party from preventing others' lawful use of a right-of-way by constructing or erecting a barricade or other blockage.

The road service area (RSA) director administers this chapter with enforcement assistance from the planning department's code compliance staff (KPB 14.40.030). A violation is subject to a civil fine of $300 under the fine schedule at KPB 14.40.380, and the borough may also pursue a superior court civil action seeking an injunction, restoration of the right-of-way, damages, or a civil penalty of up to $1,000 per violation under AS 29.25.070(b) (KPB 14.40.300(B)). An unauthorized blockage may be tagged with a 48-hour removal warning before the borough removes it and bills the owner, and the RSA director may also issue a cease and desist order requiring the blockage stop immediately (KPB 14.40.300(D)).
