Matanuska-Susitna Borough, AK Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

010(A)(2) defines an encroachment to include 'any snow storage, soil removal, debris or any other obstruction, any road, ditch, drain, gutter, or culvert which hinders or restricts' public traffic or the maintenance and flow of water along a public right-of-way, public easement, public dedication, or borough land. 030, which the borough may remove immediately at the responsible owner's expense. The borough also has the option to leave the obstruction in place and instead order the person who caused it, or the underlying property owner, to clear it themselves, after sending written notice by first-class mail or personal delivery describing the violation and the deadline for removal.

030(C) separately declares unauthorized encroachments, including obstructions, a public nuisance subject to all legal proceedings authorized by law, giving the borough a nuisance-abatement path in addition to direct removal. This obstruction rule was recodified into the definitions section by Ord. 010(A)(2), so the operative prohibition today reads through the encroachment definition rather than a separate obstruction section.
