Wyandotte County, KS Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

Sec. 27-621 governs outdoor cafés, walk-up markets, and outdoor taverns operating in the building-to-boundary area between a storefront and the property line, including the portion of that area that sits in the public sidewalk or right-of-way. Every sidewalk or pedestrian way used by such a business must stay ADA-compliant and clear, and subsection (c)(2) draws a hard line: no table, chair, sign, or other display may obstruct the sidewalk to the point that a four-foot width cannot be maintained at all times, and nothing may even hang over the airspace of that four-foot strip.

The business, not the unified government, is responsible for maintaining that pathway and keeping it free of trash and debris under subsection (b)(2). The same section layers on additional clearances: no outdoor café, walk-up market, or tavern may sit within 15 feet of a fire hydrant or bus stop, or within 30 feet of a dumpster or ten feet of a trash container on private property, and sight-distance triangles at street corners and intersections may not be obstructed. Businesses do not need a permit to operate an outdoor café if they hold a current occupation tax number, but operation within the public right-of-way itself is separately subject to Sec. 32-102, and a companion provision, Sec. 27-622, applies the identical four-foot sidewalk rule to outdoor retail displays of books, plants, art, jewelry, and crafts.
