Chapter 91, Sidewalks, Use and Maintenance, was adopted by the Bethel Board of Selectmen on 3-29-2005 to set a minimum quality standard for public sidewalks. Section 91-3(A) places year-round maintenance on the person owning or occupying the abutting real property: they must keep the sidewalk in a safe and convenient condition for public use at all times, and must forthwith repair defects and keep the walk clear of obstructions that could endanger or hinder travel. Subsection B ties any repair work to the standards in the Bethel Subdivision Regulations, Bethel Zoning Regulations and Bethel Building Regulations then in effect, so a homeowner rebuilding a cracked slab has to match current construction standards, not just patch it.

Enforcement runs through § 91-5(A): the Director of Public Works (or a designee) must first send certified or overnight mail notice, and the owner then has 30 days, weather permitting, to make the repair. Ignoring that notice puts the owner in violation of § 91-3 and exposes them to the $100 per-violation fine set in § 91-6, plus possible litigation the Town can bring in the name of the First Selectman to recover fines, costs and attorney's fees. This maintenance duty is distinct from the six-hour snow and ice removal requirement in Chapter 92, which the statute expressly carves out as an addition, not a substitute.
