Blue Hill, NE Sidewalk & Pedestrian Rules: Sidewalk Repair (2026)

Section 6-302 of the Blue Hill Municipal Code requires every owner of a lot, lots or piece of land within the corporate limits to keep and maintain the sidewalk along and contiguous to that property in good and proper repair, in a condition reasonably safe for travel for all travelers. When the city issues notice that a sidewalk is in disrepair, the owner has 48 hours from issuance of that notice to make arrangements to have the sidewalk repaired, and the repairs themselves must be completed within 21 days after the notice issues.

If an owner fails to construct or repair the sidewalk within that time after receiving due notice, two consequences follow under Section 6-302(C): the owner becomes liable for any damages or injury caused by the defective or dangerous sidewalk, and the City Council gains the power to have the sidewalk constructed or repaired itself, assessing the cost against the property. As with other Chapter 6 assessment notices, a non-resident owner must be sent a copy of any required notice by certified mail, return receipt requested, to the address on the current tax rolls before any special assessment is levied.

This maintenance duty is distinct from the construction-permit process at Section 6-303, which governs a new sidewalk built voluntarily by an owner, and from Section 6-304, which covers the city ordering a sidewalk built where none exists.
