Yuba City places sidewalk maintenance on the abutting property owner, including corner lots and damage from street tree roots, with a two-notice process, a 90-day repair window, and administrative citations or City repair-and-lien action for noncompliance.
(a)Property owner responsibility. The owners of lots or portions of lots fronting on or containing any portion of the public right-of-way, when that right-of-way is improved or if and when the area within the public right-of-way is improved, shall maintain any sidewalk in such condition that the sidewalk will not endanger persons or property and maintain it in a condition which will not interfere with the public convenience in the use of those facilities or areas. Property owner responsibility for corner lots shall include both the front and side of the lot adjacent to or containing sidewalks.
Full Breakdown
02 puts responsibility for sidewalk condition on the owner of any lot fronting or containing a portion of the public right-of-way once that area is improved, requiring the sidewalk be kept from endangering people or property and free of conditions that interfere with public use. Corner-lot owners are responsible for sidewalks on both the front and side of their lot. 12 makes the owner liable for hazards caused by City street trees within the planting easement even though the City may, at its discretion, make those repairs without charging the owner.
5 inches deep or more. 03 adopts the notice and repair procedure from Division 7, Part 3, Chapter 22 of the California Streets and Highways Code, with the City chapter controlling if the two conflict. The City sends a first notice by door hanger describing the hazard and required steps, then a second mailed notice seven to ten days later setting deadlines and describing the City's repair-and-lien process; the Public Works Director may extend the repair deadline up to 90 days for sufficient cause. Failure to repair is deemed a nuisance under Title 4, Chapter 8, supporting an administrative citation, or the City may repair the sidewalk itself and invoice the owner, who then has 90 days to pay before a lien process begins that mirrors the City's delinquent-tax collection procedure.
Violations & Fines
Failing to repair a hazardous sidewalk after the required notices is deemed a nuisance under Title 4, Chapter 8, and can draw an administrative citation under Section 6-11.03(e); alternatively, the City may perform the repair itself and invoice the property owner under Section 6-11.03(f), with unpaid invoices delinquent after 90 days collectible through a lien process identical to delinquent property tax collection.
