Section 7-9-114.6 of the Codified Ordinances of the County of Orange, part of the Zoning Code's sign article, opens with a blanket statement: "The following signs/advertising devices are prohibited," then lists eight categories. Electronic message center signs sit at item (f), defined separately at Section 7-9-135 as "a sign having the capability of presenting variable message displays by projecting an electronically controlled pattern, and which can be programmed to periodically change the message display." That covers LED billboards, programmable reader boards and similar digital display faces, whether freestanding or wall-mounted.
Unlike some entries on the list, the electronic message center ban carries no built-in exception. Item (c), flashing or blinking signs, allows relief "unless expressly allowed by the applicable district regulations," and item (a), certain advertising devices, may be permitted through a Site Development Permit. Item (f) has neither qualifier: no district regulation or discretionary permit can authorize a digital message sign under this section. The same list bans banner signs, portable signs, permanent pole signs, pylon signs, and signs that imitate traffic signals.
The prohibition applies only within the unincorporated territory of Orange County. Anaheim, Santa Ana, Irvine, Huntington Beach and the county's other 30 incorporated cities each administer their own sign codes and are not bound by Section 7-9-114.6. A property owner in unincorporated territory who wants a permanent sign must instead choose from the permitted sign types catalogued at Section 7-9-114.9, none of which include an electronic message display.
Violations & Fines
Zoning Code violations, including erecting a prohibited electronic message sign, are enforced under Section 7-9-130.3 as a misdemeanor punishable by up to $2,500 and six months in county jail, with each day of continued violation counted as a separate offense. The Director, Code Enforcement Officer or Sheriff may also pursue a civil action, capped at $2,500 per day, and declare the sign a public nuisance subject to County abatement at the owner's expense.
