Off-site billboards are otherwise banned citywide under § 15.49.050(A)(2).

(1) Zones permitted. A freeway-oriented electronic billboard may be permitted in the General Commercial (G-C), Commercial Manufacturing (C-M), Manufacturing Park (M-P) or Manufacturing, General (M-G) Zones, provided it meets all of the other requirements of this chapter. Freeway-oriented electronic billboards are prohibited in all other zones.

(3) Minimum distances. The minimum distance between two freeway-oriented electronic billboards on the same side of the freeway shall be 1,000 feet. Distance shall be measured from the nearest point of the display face or supporting structure on each billboard.

Full Breakdown

015 defines that term as a billboard "located within 200 feet of the SR-57 or SR-91 freeway right-of-way" that uses digital message technology capable of changing its copy electronically. 70, and a development agreement covering the billboard's architectural design, compensation paid to the city, city access to a share of display time for community messages, and maintenance standards. No installation can begin until the Council approves that development agreement. Subsection (F) sets the physical limits: the billboard is allowed only in the General Commercial (G-C), Commercial Manufacturing (C-M), Manufacturing Park (M-P) or Manufacturing, General (M-G) zones; two billboards on the same side of the freeway must sit at least 1,000 feet apart, measured display face to display face; and the structure must be within 200 feet of the freeway right-of-way, measured from the display face's vertical centerline to the right-of-way line.

A billboard may carry no more than two display faces, mounted back-to-back or in a V-shape, and where there is more than one face at least one must remain static rather than digital. Every billboard must plainly display the owner's or operator's name and an identification number, and utilities serving it must run underground to the extent feasible. Applicants must submit scaled drawings, a boundary map showing the nearest other electronic billboard on the same freeway side, engineer certifications of structural and soil capacity, and pay the conditional use permit and development agreement fees the City Council sets by resolution.

Violations & Fines

An electronic billboard installed without the required conditional use permit and development agreement is unauthorized under § 15.49.120(C) and, like any sign erected in violation of Chapter 15.49, is declared a public nuisance abatable under Chapter 6.01 per § 15.49.010(B) and § 15.49.110. Section 15.49.120(F)(5) also guards against malfunction: a billboard must freeze on one static image, show a full black screen, or shut off if it malfunctions, rather than display errant content.
