Las Cruces lets residents put up holiday decorations without a permit. Under the Land Development Code, decorations for national holidays and community festivals are exempt from sign permits (Sec. 36-9), but any display must be removed no later than 5 days after the event or holiday (Sec. 36-41).
The sign code defines decorations as any display calling attention to a community-organized event or a state or national holiday. Sec. 36-9(b)(4) exempts decorations for national holidays and community-wide festivals from the sign-permit requirement. Sec. 36-41(a)(3) requires any decoration display to be removed no later than 5 days after the event or holiday. Decorations tied to fiestas, community-wide festivals, or national holidays may carry a logo or message, while other decorative displays may not (Sec. 36-41). Displays must not block sidewalks, driveways, or intersection sight lines, and any noise or lighting is subject to the city's other codes.
Decorations left up more than 5 days after the holiday violate Sec. 36-41 and the city can order removal. Displays that block sidewalks or intersection sight triangles are separate code violations.
