Political signs on private residential property in Skokie are permitted consistent with First Amendment protections recognized in Reed v. Town of Gilbert (2015). The Village's sign code applies content-neutral size and placement rules but cannot single out political signs for restrictions. Signs may not be placed in the public right-of-way.
Following the U.S. Supreme Court's decision in Reed v. Town of Gilbert, 576 U.S. 155 (2015), municipalities cannot regulate signs based on content, which includes singling out political or campaign signs for special treatment. Skokie's sign code has been updated over time to be content-neutral. Residential property owners may display signs expressing political, ideological, or issue-advocacy views subject to reasonable size, number, and placement rules that apply to all signs equally. Typical limits in residential zones allow signs up to approximately 6 to 8 square feet per sign with a reasonable number per lot. Signs must be located on private property (not in the parkway strip between sidewalk and street, which is public right-of-way) and may not obstruct sight lines at intersections or driveways. There is generally no time limit requiring removal before or after elections; prior rules requiring removal within a fixed period after elections have been found unconstitutional as content-based. Illuminated or sign-supported structures may have additional requirements. Commercial properties may have different size limits under the sign code.
Signs placed in the public right-of-way may be removed by Skokie Public Works without notice. Oversized signs or signs violating content-neutral rules may trigger a notice to correct with modest fines. Contact Code Enforcement at (847) 933-8284 for questions.
