63 implements the state's expedited solar permitting mandate for small residential rooftop systems, defined at Sec. 020(b) as systems no larger than 10 kilowatts AC nameplate rating or 30 kilowatts thermal, installed on a single- or duplex-family dwelling, that meet applicable building and health and safety codes and do not exceed Fremont's maximum legal building height. Sec. 010 states the chapter exists to comply with the Solar Rights Act and AB 2188 (Cal. Gov't Code Sec. " Under Sec. 060(a), the building official must run an "administrative, nondiscretionary review process," and where the application meets the city's approved checklist and standard plan, the Building and Safety Division must approve or deny the permit the same day for over-the-counter applications, or within one to three days when same-day, over-the-counter review is not feasible; review is limited strictly to whether the application meets local, state and federal health and safety requirements.

Only if the initial submittal shows the system could have a specific, adverse impact upon public health and safety may the building official instead require a discretionary solar use permit under Sec. 300. Fremont's inspection process is likewise streamlined: Sec. 060(g) allows only one inspection for systems eligible for expedited review, with a subsequent inspection authorized only if the first fails.
