Fremont, CA Solar Energy: Panel Permits (2026)

Sec. 050 sets the intake side of Fremont's small residential rooftop solar program, which under Sec. 030(a) applies to permitting "all small residential rooftop solar energy systems in the city," meaning systems no larger than 10 kilowatts AC or 30 kilowatts thermal on a single- or duplex-family dwelling. Subsection (a) requires the city to post every document needed for an expedited application on its website, and subsection (b) requires that electronic submittal of the permit application and supporting documents, including by facsimile, be made available to every applicant, with an electronic signature accepted on all forms in lieu of a wet signature.

Subsection (c) puts the compliance burden on the Building and Safety Division: it must adopt a standard plan and a checklist of every requirement a system has to meet to qualify for expedited review, and that checklist must substantially conform to the recommendations in the current California Solar Permitting Guidebook published by the Governor's Office of Planning and Research. A system already legally installed or permitted before the chapter's July 7, 2015 effective date does not need a new permit under Sec. 030(b) unless later physical modifications materially change its size, type or components; routine maintenance and like-kind replacement parts never require a new permit.

If a system sits on a property with a registered or potential historic resource, Sec. 175 before the solar permit can issue. Permit fees are set separately by city council resolution under Sec. 070.
