The Solar Rights Act applies to both single-family and common-interest developments. AB 2188's streamlined permitting provisions also limit local government restrictions. HOAs must respond to solar applications within a reasonable timeframe.
HOA provisions violating the Solar Rights Act are void and unenforceable. Homeowners may sue HOAs for damages and attorney's fees for unreasonable obstruction of solar installations.
