Tier 1 systems, roof-mounted and building-integrated systems, are permitted in any zoning district but must be installed parallel to a pitched roof surface, sit within eight inches of the roof on pitched installations, not extend higher than the roof's highest point, and on flat roofs not exceed the parapet or 24 inches above the roof surface, whichever is higher; panels must carry an anti-reflective coating. Tier 2 systems, ground-mounted units up to 25 kW AC generating no more than 110% of the site's trailing twelve-month consumption, are allowed as an accessory use in the General Industrial District or by Board of Zoning Appeals special permit under § 211-65A in the R1-44, R1-18, R1-10 and R1-E single-family districts on lots over one acre, rear yard only, or in the Flexible Office Industrial or Light Industrial districts, and must be screened and meet the underlying district's setback, height and lot coverage rules.
Tier 3 systems, everything larger, are principal permitted uses in the General Industrial District subject to site plan approval, or allowed in the Flexible Office Industrial District by special permit plus site plan approval, and must sit back 100 feet from the zoning district boundary and 25 feet from any internal property line.
Violations & Fines
Installing a solar energy system without the required Building Inspector permit, or in a tier/district combination not authorized by § 211-61D, is enforced under the Chapter 211 general penalty at § 211-72: up to $1,000 or six months for a first offense, $1,000-$5,000 for a second offense within five years, and $2,500-$10,000 for a third offense within that period, with each week of continued violation a separate offense.
