Kauai County, HI Solar Energy: Panel Permits (2026)

Section 105.1.1, added to the County's amendments to the International Building Code, requires anyone installing a solar energy system, including solar photovoltaic power systems and solar water heating systems as defined in Section 12-2.2, to obtain a permit before work starts. The only exception covers solar work performed by an electrical utility or a serving agency operating under a state franchise or charter; homeowners and licensed contractors installing rooftop panels or water-heating collectors on private property do not qualify for that exception and must apply through the Building Division.

Under Section 105.3.1, a solar permit covers the building, electrical, and plumbing code requirements tied to the system and the scope of work for each specialty classification, so a single application can bundle the structural mounting, wiring, and any related plumbing work rather than requiring three separate permits. Permits may be issued to a homeowner complying with Chapter 444, Hawai'i Revised Statutes, or to a licensed contractor holding a valid, unexpired license under that chapter. Once the permit issues, Section 110.1.1 makes the installation subject to inspection by the building official, and Section 110.5 requires the permit holder or an authorized representative to request that inspection, generally at least two working days before the requested date.

Solar permits follow the same expiration rule as other building permits under Section 105.5: the permit lapses if work has not commenced within 180 days of issuance.
