San Marcos provides streamlined solar photovoltaic permitting in compliance with California AB 2188 and SB 1222. Residential rooftop systems up to 10 kW on single-family or duplex homes qualify for expedited permitting with electronic plan submission through Development Services at (760) 744-1050 x3233. Applications for qualifying systems must be approved or denied within 1 business day. Systems must comply with NEC Article 690 and California Fire Code setback requirements for rooftop access and ventilation. Ground-mounted systems require standard building permits and must comply with SMMC Title 20 zoning setbacks. Electrical interconnection is coordinated with San Diego Gas & Electric (SDG&E) through their NEM application process. Battery storage systems (e.g., Tesla Powerwall) require separate electrical permits. The city cannot require HOA approval as a condition of permit issuance per California Civil Code 714.
Unpermitted solar installations may require removal and reinstallation with proper permits. Work must be performed by licensed C-10 or C-46 contractors.
