Summary

In the Village of Southampton, a homeowner or occupant who files the official form with the Village Clerk bars vendors, peddlers, fundraisers and handbill distributors from entering that residential property. The Clerk keeps a street-indexed registry, and the article prints no solicitation hours; the notice works as a standing ban.

A. If the owner or occupant of any private residential property in the Village of Southampton has given notice in the manner set forth in § 84-2 of this Article, no person shall enter upon said private residential property for the purpose of vending, peddling or soliciting orders for any merchandise, service, device, book, periodical or printed matter whatsoever; nor for the purpose of soliciting alms or a subscription or a contribution to any church, charitable or public institution whatsoever; nor for the purpose of distributing any handbill, pamphlet, tract, notice or advertising matter; nor for the purpose of selling or distributing any ticket or chance whatsoever. B. Nothing herein contained shall be construed to apply to any person who has been a bona fide resident of the Village of Southampton for a period of at least six consecutive months last past, nor to any person who has maintained a place of business in the Village of Southampton for a period of at least six consecutive months prior thereto, or his duly authorized representative

Full Breakdown

Article I of Chapter 84 of the Southampton Village Code, adopted August 15, 1980 as Local Law No. 3-1980, is a registry system rather than a curfew. Under § 84-1A, once the owner or occupant of private residential property in the Village of Southampton has given notice under § 84-2, no person may enter that property to vend, peddle or solicit orders for any merchandise, service, device, book, periodical or printed matter; to solicit alms or a subscription or contribution to any church, charitable or public institution; to distribute any handbill, pamphlet, tract, notice or advertising matter; or to sell or distribute any ticket or chance. The article sets no daily hours. The notice itself is the rule, and § 84-2A says a person who enters after notice is not licensed or privileged to be there and enters unlawfully.

Section 84-2B sets the filing method: sign an official form supplied by the Village Clerk and file it in the Clerk's office, describing the property by street and number. Section 84-1B adds an exception for people who have been bona fide Village residents for at least six consecutive months, or have kept a place of business in the Village for that long, but only where the owner or occupant elected that exception by checking the squared space on the form under § 84-3. Without the check, the ban applies to those local callers too. Either choice can be withdrawn at any time, and the Clerk notes the date on the form (§ 84-4).

Section 84-5 requires the Clerk to maintain a street-by-street filing system and a signed list of every registered property. Anyone who wants to solicit can inspect it, and a copy of the list costs $0.25 per page.

Violations & Fines

Section 84-6 sends violations of Article I to the penalties in Article II of Chapter 1 of the Village Code. Under § 1-17 a conviction is a violation under the Penal Law, punishable by a fine not exceeding $2,000 or imprisonment for a term not exceeding 15 days, or both, with community service as the court directs. Each day a continuing violation lasts is a separate offense.

Frequently Asked Questions

How do I stop solicitors at my home in the Village of Southampton?
Sign the official form supplied by the Village Clerk and file it in the Clerk's office, describing the property by street and number. Once filed, § 84-1A bars any person from entering the property to vend, peddle, solicit orders or contributions, or distribute handbills.
Does the code set hours for door-to-door solicitation?
Article I prints no solicitation hours. Its rule depends on the notice: where the owner or occupant has filed the form, entry for the listed purposes is unlawful at any time. Where no notice is on file, Article I does not bar entry.
Can neighbors and local businesses still knock after I file?
Only if you choose it. Section 84-1B exempts people who have been bona fide Village residents or have kept a Village place of business for at least six consecutive months when the owner or occupant checks the squared space on the form under § 84-3. Unchecked, the ban covers them too.
