Section 110-47 says it was enacted under § 1640 of the New York State Vehicle and Traffic Law and Municipal Home Rule Law § 10.1(i) and 10.1(ii)a(6). Section 110-48 states the purpose: to promote sustainable and alternative transportation practices, to manage the availability of off-street parking, particularly in areas that will maximize the use of electric vehicles, and to improve traffic and parking circulation.

Section 110-49 defines the terms. An electric vehicle is a vehicle that operates, either partially or exclusively, on electrical energy from the electrical grid or an off-grid source that is stored on board for motive purposes, so a vehicle that runs only partly on stored electricity counts. An electric vehicle charging station is equipment whose primary purpose is the transfer of electric energy to a battery or other energy storage device on an electric vehicle.

Under § 110-50, the director of public works, or a designee, designates the spaces, and only in off-street public parking facilities. The Public Works Department must then place signs or markings giving adequate notice that the space is restricted to such electric vehicles, and the signs or markings must indicate that vehicles left standing in violation of the restriction can be removed. The parking restriction does not apply to a designated space until the sign or markings have been placed.

Section 110-51 sets four prohibited conditions at a posted space: parking a nonelectric vehicle, an electric vehicle that is not connected to the charging station, an electric vehicle that is not charging, or an electric vehicle that has been charging for more than four hours.
