The Board can refuse if access exists so that loading can be done in conformance with the section by due diligence without undue hardship, or if the goods can be carried on foot or by other means from a nearby point where parking is permitted.
Subsection D lets the Mayor or a member of the Board of Trustees issue an emergency permit for a single situation if three conditions are met: the matter cannot be presented at a Board meeting within the limits of the emergency, delivery without parking is impossible without undue hardship after due diligence, and undue hardship will result if delivery is deferred or advanced to a permitted time. Subsection E bars stopping or parking on the roadway side of a vehicle already at the curb, except in compliance with the law or a police officer's directions.
Elsewhere in the Village, § 110-21(F) defines a "loading zones" location: standing or parking is prohibited except for the express purpose of loading or unloading merchandise and goods.
Violations & Fines
Under § 110-4(C), anyone who causes a vehicle to be parked or remain standing in violation of § 110-31 is liable to a fine of $75. A vehicle left unattended where stopping, standing or parking is prohibited can also be removed by the Police Department at the owner's or operator's cost under § 110-28(A), with the removal expense limited by § 110-29 to $35 from 6:00 a.m. to 6:00 p.m. and $50 from 6:00 p.m. to 6:00 a.m., plus storage charges.
