Full Breakdown
Section 36-2 of the Georgetown Code is the special license and regulatory fee section. The city council finds that the listed enterprises generate extraordinary traffic and necessitate inordinate police activity, so they need special regulation and supervision. The police license fees are imposed on every person involved in the activity named, and the fee is paid to the city director of finance, in advance for enterprises not operating throughout the year or by the start of the fiscal year for enterprises in continuous operation.
Subsection (9) covers peddlers and solicitors: every natural person engaged in peddling any goods, wares or merchandise of any kind, or soliciting orders for them, in the city pays an annual license fee of $25.00. The code names a natural person, so the fee attaches to the individual doing the selling or soliciting.
Subsection (7) is a separate and higher-fee category for itinerant merchants. A person who transacts any temporary or transient business in the city for the sale of goods, using a building, structure, motor vehicle, tent, lot, public room or any street, alley or other public place, for a period of less than one year, pays $150.00. Temporary association with a local merchant does not remove the obligation. Booth vendors at a festival do not pay separately; the festival sponsor pays a one-time fee of $300.00 instead.
Where a solicitor can work is also limited. Section 32-26 makes it unlawful to sell or offer to sell goods from a wagon or other conveyance or a temporary stand on Main Street between Mulberry Street and Water Street, on Broadway Street between Washington Street and College Street, or between the city building and Main Street on the Court House Square, and a license is not operative on those blocks. Section 28-7 prohibits soliciting within streets and roads: no person may solicit, approach, impede or interfere with motorists' attention, progress, safety or compliance with traffic control.
Violations & Fines
Section 28-7 sets the printed penalty for soliciting within streets and roads: a fine of not less than $20.00 nor more than $100.00 for each offense, as set out in KRS 189.990. Selling from a conveyance or temporary stand on the protected blocks of Main Street, Broadway Street or the Court House Square is unlawful under section 32-26, and a peddler's license does not authorize sales there. Section 36-2 prints the $25.00 annual fee but no separate penalty amount of its own.
