Full Breakdown

Article 8-01 of the Prescott Valley Town Code, titled Peddlers, covers three kinds of seller. A solicitor is anyone who goes from house to house, place to place or street to street taking or attempting to take orders for goods or for services to be performed in the future, whether or not a sample is carried or advance payments are collected. Section 8-01-020(A) makes it unlawful for any peddler, solicitor or transient merchant to engage in that business in the Town without first obtaining a license. The Town Council last amended the definitions and the license requirement by Ordinance 2025-972, enacted December 11, 2025.

Applicants file a sworn written application with the Town Clerk on the Clerk's form. Section 8-01-040(A) asks for the applicant's name and physical description, permanent home and local address, a description of the business and the goods, the employer's name and address with credentials showing the relationship, the source of supply and method of delivery, a recent head-and-shoulders photograph of approximately two inches by two inches (covering any helpers too), a statement of any convictions other than traffic violations, the most recent cities or towns, not to exceed three, where the applicant did business, and a description of the vehicles and license numbers used. Fees come from the Comprehensive Fee Schedule under section 8-01-060.

Every new application goes to the Prescott Valley Police Department for investigation and criminal record review on behalf of the Town Clerk. Under section 8-01-050(B), a license can be denied or revoked if the applicant was convicted within the five years before applying of a felony involving trafficking in stolen property, fraud, forgery, theft, burglary, robbery or extortion, a drug sale felony, a violent crime, a sexual offense, or a misdemeanor involving moral turpitude. Licenses run for one year and must be renewed. Under section 8-01-070 the licensee must show the original license when any citizen asks, and a copy does not satisfy the rule.

Section 8-01-030 exempts wholesale sellers to dealers, court-ordered sales, bona fide auctions, people invited to a private residence after prior contact with the occupant, approved special event vendors, and religious, charitable and other federally exempt organizations. Businesses where the state has preempted local licensing, such as alarm businesses and contractors, skip the background-check section.

Violations & Fines

Violating Article 8-01 is a class 3 misdemeanor under section 8-01-130, punished as section 8-02-100 provides: a fine not to exceed $500, imprisonment not to exceed one month, or both, with each day a separate offense. The same conduct is also a civil offense carrying a civil sanction capped at the class 3 fine. The Town Manager can temporarily revoke a license by summary order under section 8-01-100, with a Hearing Officer hearing set within seven days, and a person whose license was revoked or refused cannot reapply for one year.
