A permit fee may be charged to offset costs. Such fees shall be established by resolution of the city council. The administrative services director shall issue permits for the exclusive use of any public facility described in subsection (a) during certain times unless one of the following grounds is found to exist: (1) The proposed use of a specified facility for a certain time is in conflict with a previously issued permit for the same facility. (2) The proposed use will have a significant adverse impact on or present an imminent threat of damage or injury to the facility or the public health, safety, and welfare.

The director can charge a permit fee, set by resolution of the city council, and is directed to apportion facility use fairly among competing groups.

The director must issue the permit unless one of three specific grounds applies: the requested time conflicts with a previously issued permit for the same facility, the proposed use presents a significant adverse impact or imminent threat of damage or injury to the facility or to public health, safety and welfare, or the proposed use would violate this article or any other federal, state, county or city law. A separate permit process applies to staged events: Sec. 12-55 requires anyone setting up an exhibition, concert hall, show, performance or amusement in a park to get a permit from the Parks and Recreation Commission itself, distinct from the facility reservation permit under Sec. 12-53.

Using a reserved park facility without a permit, or violating a permit's conditions, is enforced as disorderly conduct under Sec. 12-20: park officials and any city employee authorized to enforce the Code can eject the offender on the spot. Three or more violations by the same person within the same park in any 12-month period is declared a public nuisance the city can abate through civil injunction proceedings, and the offender can be barred from that park for up to 12 months.
