Full Breakdown
Permits are issued by the Director of Parks, the person immediately in charge of the Department of Parks. Section 158-10(D) requires a permit before participating in park activities designated by the Director.
The application is filed with the Director and must state the name and address of the applicant; the name and address of any person, corporation or association sponsoring the activity; the day and hours for which the permit is desired; the park or portion of a park; an estimate of the anticipated attendance; and any other information the Director finds reasonably necessary.
The Director shall issue the permit when he finds five things: the activity will not unreasonably interfere with or detract from the general public enjoyment of the park; it will not unreasonably interfere with the promotion of public health, welfare, safety and recreation; it is not reasonably anticipated to incite violence, crime or disorderly conduct; it will not entail unusual, extraordinary or burdensome expense or police operation by the Township; and the facilities desired have not been reserved for other use at the day and hour required.
Within two days after receipt of an application, the Director must tell an applicant in writing the reasons for refusing a permit. An aggrieved person has two days to appeal in writing to the Township Council, which applies the same standards and must sustain or overrule the Director within seven days. The Council's decision is final.
After issuance, the permittee is bound by all park rules and applicable ordinances as though inserted in the permit, is liable for loss, damage or injury sustained by any person by reason of the permittee's negligence, and can lose the permit: the Director can revoke it on a finding of violation of any rule or ordinance or on good cause shown. Section 158-10 prints no permit fee.
Violations & Fines
The § 158-12A schedule fines Group Permits/Supervision of Minors at $50.00 for a first offense and $100.00 for a second, Game and Area Permits at $50.00 and $100.00, Meetings, Exhibitions at $70.00 and $150.00, Amplified Music at $50.00 and $100.00, and Alcohol permit required at $100.00 and $200.00.
