Full Breakdown
Section 20-29 of the Code of Ordinances requires anyone who wants exclusive use of a city park, part of a park, or a specific park facility to apply for a permit through the parks and recreation department. The department must issue the permit when the proposed use will not unreasonably interfere with the public's general enjoyment of the park or with public health, welfare and safety; is not anticipated to incite violence, crime or disorderly conduct; will not entail unusual expenses; and when the facility is not already reserved for the requested time and is suitable for the planned activity.
All fees and deposits are set by city council resolution after a recommendation from the parks and recreation board, and the current rates are published in the parks and recreation department office. Events involving food or drink require a refundable cleanup deposit, forfeited if the park is not cleaned within 24 hours of use; events needing a city key require a refundable key deposit, returnable within 24 hours, though league officials can hold seasonal keys under a standing deposit. Ballfield lighting for activities the city has not already budgeted is billed from an approved light fee schedule.
Permit holders are bound by all park rules and ordinances as if written into the permit itself, and are liable for any loss, damage or injury caused by their own negligence. The associate director of parks or recreation can revoke a permit for any rule violation or other good cause. A denied applicant can appeal in writing to the city manager within five working days, and the city manager's decision to sustain or overrule the parks department follows within five working days of receiving that appeal.
Violations & Fines
Violating Section 20-29's permit terms, or any ordinance a permit incorporates, is a petty misdemeanor under Section 20-30, punishable in line with the Code's general penalty, Section 1-10. The associate director of parks or recreation can revoke the permit outright for a rule violation or other good cause, and park rangers and city officials can eject violators from the park.
