Chapter 9 of Title V, the Milpitas park rules, opens Section 4 with a blanket rule: unless a written permit is first obtained from the City Manager or an authorized agent, it is unlawful to do any of the acts listed in that section inside a Milpitas park (Milpitas Municipal Code § V-9-4.00). Those permit-triggering acts include operating a trade, business, or concession such as peddling, hawking, or vending goods (§ V-9-4.01), soliciting donations (§ V-9-4.02), and using a loudspeaker or other noise-amplifying device (§ V-9-4.05).

The Council has stated its intent that business and concession permits be granted only in exceptional circumstances of benefit to the community at large, so an organizer planning a park gathering, fair, or fundraiser should expect the City Manager's office to weigh the request against that standard before issuing conditions. The permit requirement sits alongside, but is separate from, the park's closing-hours rule in § V-9-6.00, which lets the City Council set opening and closing hours by minute action or resolution. City officers and employees performing park maintenance duties, and on-duty Police, Fire, or Health Department staff, are exempt from the permit chapter under § V-9-5.00.

Because Milpitas parks include facilities with their own posted rules, such as the dog park at Ed Levin Park (§ V-9-7.01) and the Milpitas Skate Park (§ V-9-7.02), an event permit applicant also has to work around those facility-specific restrictions.
