Milpitas, CA Special Events & Permits: Sidewalk Dining & Cafés (2026)

Milpitas regulates outdoor dining at Subsection C.10.100.E (Outdoor Dining) within the Eating and Drinking Establishments chapter of its zoning ordinance. Under Subsection E.1, a new or modified outdoor dining area on private property is approved with a Minor Site Development Permit, and where a restaurant already holds a Conditional Use Permit, adding or modifying outdoor dining needs only the Minor Site Development Permit, not an amendment to the existing Use Permit. The application must include written permission from the property's owner of record, and it is also reviewed and approved by the Fire Department.

Location standards in Subsection E.2 require a minimum five-foot pedestrian path of travel to building entrances, a two-foot setback from adjacent parking spaces, and bar an outdoor dining area from being separated from the restaurant by a vehicular drive aisle or from encroaching on loading zones or stormwater treatment areas. Restaurants can convert existing parking spaces to dining areas and get a parking-count break: Subsection E.3 allows up to a 15 percent reduction in required parking for an 800-square-foot-or-smaller dining area, rising to 30 percent in mixed-use and commercial zones, though ADA-required accessible spaces can never be removed for this purpose.

Subsection E.4 sets design rules for barriers (no chain link, corrugated metal, or unfinished wood; solid portion capped at three feet, six feet with plexiglass above it) and overhead shade structures (12-foot maximum height, no plywood or corrugated polycarbonate). Subsection E.7 fixes hours: outdoor dining cannot start before 7:00 A.M. and must end by 10:00 P.M. Sunday through Thursday or 11:00 P.M. Friday and Saturday, and smoking or vaping is banned in the dining area.
