03 makes it unlawful to operate a Sidewalk Cafe on any city sidewalk without first obtaining a permit from the City Engineer and paying the required fee; only restaurants and retail tobacco shops offering chairs, benches or tables qualify. 02 confines Sidewalk Cafes to geographical Cafe Zones the City Commission designates by resolution, and allows one-year Temporary Cafe Zones to test new areas. 04 requires the application to include the applicant's name and address, a valid restaurant business license, current liability insurance, a drawing of the sidewalk layout and dimensions, and photos or brochures of the proposed furniture, reviewed by Risk Management, Finance, Engineering, Planning, and the Community Redevelopment Agency's Executive Director.

05 sets physical standards: no tables or chairs within five feet of a bus stop, taxi stand or counter service window; none within two feet of a pedestrian crosswalk; a five-foot setback for any Entertainment Area from an adjacent business; and a minimum four-foot clear pedestrian path everywhere except the Broadwalk, where furniture must sit within six feet of the property line and an eleven-foot pedestrian pathway must remain open. Cooking facilities are banned on the sidewalk except temporary equipment used only to finish meals substantially prepared inside, subject to Fire Marshal approval.

06 requires the permittee to indemnify the city and carry at least $1,000,000 in combined public liability, food products liability and property damage insurance naming the city, the CRA and FDOT as additional insureds. 07, each permit runs for one year subject to renewal, is personal to the permittee and non-transferable, and can be suspended for a City Commission-approved special event without a fee refund.
