A. Permit Required. A sidewalk dining/decorative display permit shall be required for any tables, chairs, benches, displays, or other appurtenances placed in the public right-of-way for the purpose of establishing a sidewalk dining area or sidewalk decorative display. The zoning administrator shall issue such permit upon a finding that the requirements of this section have been met. B. Location. Sidewalk dining areas and sidewalk decorative displays within the public right-of-way are permitted only within the downtown revitalization district as delineated in Chapter 18.74 of this code.

Physical standards are specific: a four-foot unobstructed pedestrian clearance from any furniture or display, a two-foot clearance from the face of curb, an eight-foot clear zone perpendicular from any doorway, a 50-square-foot cap on decorative displays, and daily removal of furniture and displays after business hours (planters and approved enclosures may stay).

Alcohol service is allowed only in conjunction with a restaurant as defined in the section, requires an enclosure between one and three feet high, posted signage against removing drinks, and a current Department of Alcoholic Beverage Control license; losing that ABC license automatically terminates the city permit. If a sidewalk dining or decorative display area sits unused for 10 continuous days, the permittee must wash or buff the sidewalk surface to the satisfaction of the superintendent of streets. The section was last amended by Ordinance 2179 § 2 in 2018.
Violations & Fines
The zoning administrator or designee can order immediate correction of an obstruction or unsanitary condition and, if the permittee does not comply, move the obstruction or remove furniture and displays at the permittee's expense. The director of operation services, police chief or city engineer may suspend or prohibit operation at any time for conflicts such as festivals, street repairs or emergencies. The zoning administrator may revoke the permit after a hearing for noncompliance, and must suspend alcohol service and hold a hearing if patrons show a pattern of loud, offensive or abusive behavior or remove drinks from the area. Decisions are appealable under Section 13.04.490.
