Sec. 28-361 of the Land Development Regulations treats outdoor areas of seating as an accessory use permitted with limitations, and every outdoor seat counts toward the parking required for the site in every zoning district where it is allowed. The operating hours and setbacks are district-specific. and cannot sit within fifty feet of a residential property line. m. The Downtown Mixed-Use (DMU) district carries its own set of rules. on weekends whenever the seating sits within fifty feet of the Residential Historic Preservation district. DMU outdoor seats count toward the restaurant's total permitted seating and cannot make the restaurant's required off-street parking fall short.

Seating cannot encroach on rights-of-way or easements except sidewalks, civic spaces and plazas, and where seating occupies a public or private sidewalk, the operator has to keep clear either a five-foot pedestrian path or half the sidewalk width, whichever is greater, maintained at all times. Tables and chairs also have to stay five feet clear of bus stops, fire hydrants, above-ground utilities, bike racks and other street furniture, and the area must be kept free of debris and cleared at the close of each business day; the city manager or a designee can order tables and chairs removed or relocated immediately if doing so is necessary to protect public health, safety or welfare.
