Port Orange City Code Section 58-51(1)(e), in Chapter 58's Article III on special events, treats an event as a regulated special event once at least three merchants other than the host establishment take part, alongside other triggers like temporary structures or exceeding normal on-site parking. Section 58-51(6) defines merchant activity as the outdoor sale, display, promotion or giveaway of merchandise, products or services by a person at a special event, while Section 58-51(8) defines a special event temporary merchant as any merchant conducting that activity on a sponsor's property who is not the sponsor.

Section 58-52(b) requires the special event sponsor to obtain a special event temporary merchant permit for each such vendor whenever the event runs alongside a regional event like Bike Week, Biketoberfest or the Daytona race weeks. Section 58-54(b)(5) then requires the sponsor to give the city manager or a designee, 48 hours before the event, a list specifying the total number of temporary merchants, their names, and the goods or services each will provide; the city uses that list to issue the individual merchant permits and to collect the temporary merchant fee set by council resolution.

Additional merchants can be added after the event starts as long as the sponsor stays within the total approved on the permit and pays all fees. Section 58-56(a)(4) requires each temporary merchant permit to be posted where the passing public can see it. Violations run through Section 58-58: the city manager can issue a notice of violation, suspend the merchant's display area until cured, or revoke the whole event permit for uncured or serious violations, with Section 58-60 penalties matched to the Code's general penalty section 1-8 and each day of violation treated as a separate offense.
