North Carolina Fireworks Law and Local Preemption Limits

G.S. 14-414 makes it unlawful to manufacture, sell, possess, or use 'pyrotechnics' except those specifically defined as permissible under G.S. 14-414(1). Permissible items are limited to sparklers, fountains, smoke devices, snake or glow worms, trick noisemakers, and similar non-aerial, non-explosive items. Aerial devices like bottle rockets, Roman candles, mortars, and firecrackers are prohibited statewide regardless of local ordinance. Public display permits require approval from the local fire marshal under G.S. 14-413, but the underlying classification of permissible versus prohibited fireworks is set by state law.

Possession or use of prohibited fireworks is a Class 2 misdemeanor under G.S. 14-415, punishable by up to 60 days in jail and a fine. Manufacturing or selling prohibited pyrotechnics carries enhanced penalties, and violators may also face civil liability for fires.
