Utah EV Charging Station Standards and HOA Rules

Utah Code § 57-8a-802 (Community Association Act) and § 57-8-8.2 (Condominium Ownership Act) bar associations from prohibiting an owner's electric-vehicle charging system on the owner's lot or assigned limited common area, while allowing reasonable safety, insurance, and cost conditions. The sections previously cited here, § 57-8-16.7 and § 57-8a-209, do not govern EV charging; § 57-8a-209 concerns rental restrictions. Utah also plans public EV-charging corridors through the Department of Transportation, and the Department of Agriculture and Food's Weights and Measures program checks commercial charger accuracy. Local governments may permit but not prohibit code-compliant residential charging.

An HOA that flatly bans EV chargers on owner-controlled property in violation of § 57-8a-802 or § 57-8-8.2 may face civil suit and attorney-fee awards; uncertified public chargers can be red-tagged by Weights and Measures.
