Virginia Statewide Consumer Fireworks Restrictions

Virginia Code Section 27-95 through 27-100.1 prohibits possession, sale, transport, or use of fireworks that explode, travel laterally, or rise into the air. Permitted devices are limited to sparklers, fountains, pharaoh serpents, caps for pistols, and pinwheels that remain stationary on the ground. Localities may further restrict permitted fireworks but cannot legalize prohibited devices. Permits for public displays must be obtained from local fire officials and conducted by licensed pyrotechnicians.

Unlawful possession or use is a Class 1 misdemeanor, punishable by up to twelve months in jail and a fine up to $2,500. Selling prohibited fireworks may incur additional civil penalties.
