An above-ground pool in Dublin needs a building permit once it is 24 inches or deeper or holds more than 5,000 gallons (California Building Code Section 105.2). Regardless of permit status, any pool holding water more than 18 inches deep must meet the California pool barrier rules enforced through Dublin's Building Division.
Dublin applies the California Building Code, under which Section 105.2 exempts from a building permit a prefabricated swimming pool accessory to a single-family (R-3) home that is entirely above ground, less than 24 inches deep, and no more than 5,000 gallons. Above that threshold, an above-ground pool requires a Dublin building permit. Permit status does not remove the safety obligation: California Health & Safety Code Section 115921 defines a swimming pool as any structure holding water more than 18 inches deep, so once an above-ground pool exceeds 18 inches it triggers the Section 115922-115923 barrier and safety-feature rules. Where the pool wall itself is tall enough (commonly 48 inches or more), it can serve as the barrier provided the ladder or steps are removable, lockable, or gated with self-closing, self-latching hardware when the pool is unattended, consistent with the California Residential Code (Appendix AX). Dublin verifies the barrier at the pre-plaster/barrier inspection before the pool is filled.
Installing an above-ground pool over the 24-inch / 5,000-gallon threshold without a permit lets the Building Division issue a stop-work order and assess corrective/investigation fees. Leaving an access ladder up on a barrier-pool when unattended, or failing the barrier inspection, can be pursued as a municipal code violation by Dublin Code Enforcement.
