A non-compliant barrier fails the pre-plaster/barrier inspection, so the pool cannot be filled or finaled. Removing or disabling a required barrier or gate after installation can be pursued as a municipal code violation by Dublin Code Enforcement, and a drowning at a pool lacking the required safety features can support civil negligence claims under California law.
