California Health and Safety Code 115920 (Swimming Pool Safety Act) applies in Berkeley and requires any new pool or spa over 18 inches deep to have an enclosure at least 60 inches high with maximum 4-inch openings, no handholds or footholds on the exterior, and gates that open outward from the pool, are self-closing and self-latching with the latch at least 60 inches above the ground. In addition, pools must have at least two of seven approved safety features: approved pool cover, removable mesh fencing with self-locking gate, door alarms, self-closing self-latching pool access doors, pool alarms, swimming pool enclosure per ASTM F2286, or other approved means. Berkeley inspects barriers at final inspection and will not sign off until all requirements are met.
