Per 2022 CBC §3109.2 (incorporating California Health & Safety Code §115923), every San Leandro pool or spa must be completely surrounded by a fence/enclosure at least 5 feet high, with self-closing self-latching gates that swing away from the pool and have latches at least 60 inches above grade.
San Leandro's Swimming Pool and Spa Plan Submittal Requirements (Safety Features section) require a complete fence or enclosure at least 5 feet in height surrounding the pool or spa (the house may be part of the enclosure). The outside surface must be free of handholds/footholds that would let a child under five climb over. Maximum ground clearance under the fence is 2 inches; gaps must not allow passage of a sphere greater than 4 inches. Access gates through the pool surround must be self-closing and self-latching, must swing away from the pool area (egress direction), and must have latches no lower than 60 inches above grade or finished floor (2022 CBC §3109.2 / H&S Code §115923(a)). A garage man-door with direct access to the pool area must be self-closing and self-latching with a gate-type latch at least 60 inches above the floor — or equipped with an audible alarm meeting the §115923(a)(4) specs. Setbacks for the pool/fence are routed through the Planning Division.
Operating a pool without a code-compliant barrier is a building/safety violation. Code Enforcement may issue notices to abate, citations, and stop-use orders. Non-compliance also creates civil liability and may void the Certificate of Occupancy for the pool until corrected.
