San Clemente applies the Swimming Pool Safety Act to any pool, spa or hot tub 18 inches or more deep, so a typical above-ground pool is regulated like an in-ground pool and needs a building permit and barrier. Under BI-17, where the pool structure is the barrier and access is by a ladder or steps, either the ladder must be capable of being raised, locked or removed, or it must be surrounded by a barrier meeting the full 60-inch, non-climbable rules. A pool wall under 60 inches or climbable still needs a surrounding fence, and two safety measures remain required. Any pool over 18 inches deep is not exempt; equipment must meet the noise ordinance and GFCI and bonding rules.
Installing an above-ground pool without a permit or without a compliant, non-climbable barrier is a code violation. If the pool wall is the barrier, leaving the ladder or steps usable, not raised, locked, removed or fenced, defeats the barrier.
